Publish Date: 2004-03-01
Features: Based on the previous edition, this book has been appropriately revised with significant changes, where many topics are almost completely rewritten, hence the title "newly revised." Due to this revision, the book has become larger and is published in two volumes. The first volume mainly includes the occurrence of obligations and the subject matter of obligations, while the second volume covers the effects of obligations, joint and several debtors and creditors, the transfer of obligations, and the extinction of obligations. The format of this book largely maintains the style of the previous edition but still has notable differences. Four points deserve special mention: (1) Reflecting on methodology to enhance the critical commentary on major controversial issues in the general theory of obligations; (2) rigorous exploration of the context and systematic structure of legal interpretation; (3) refining and cautiously applying legal methodology, particularly teleological interpretation and analogy; (4) a careful review and specific examination of the revision achievements of the Obligations Chapter of the "Civil Code of the Taiwan Area." It is hoped that these four aspects will help readers gradually delve into the realm of obligation law. Regarding the revised articles of the Obligations Chapter of the "Civil Code of the Taiwan Area."
