It compiles the doctrines of renowned domestic and foreign scholars, legislation and treaties of relevant countries, typical cases, and indexes of papers and works in sequence. With its innovative format, authoritative, accurate, and comprehensive materials, it is a rare resource for the study, teaching, and learning of international private law. The book features a novel structure, extensive sources, and a fusion of doctrines, legislation, cases, and literature. It extracts authoritative arguments from contemporary domestic and foreign scholars, collects and compares new legislation and cases from various countries, and includes bilingual references in Chinese and English. It is truly a valuable resource for teaching and research in international private law, and it will also greatly benefit China's future legislation in this field.
This book is organized according to the format of Professor Huang Jin's International Private Law (published by the Law Press in 1999) with the aim of providing a comprehensive and systematic reference for the teaching and research of international private law in China, thereby promoting the development of the discipline. The selected materials are broadly sourced from Chinese and foreign legislation, cases, and doctrines, arranged in both Chinese and English, forming a self-contained system with distinct features, which are detailed as follows:
First, in terms of structure, it breaks the traditional model of lumping regulations and cases together while keeping them separate. Under each chapter, the book compiles the doctrines of renowned domestic and foreign scholars, legislation and treaties of relevant countries, typical cases, and indexes of papers and works, allowing readers to locate the required materials relatively easily and gain a more comprehensive understanding of relevant issues.
Second, in the collection of materials, due to the current demand for bilingual teaching, the editors directly use English sources when collecting and organizing the doctrines of foreign scholars and other materials, if the original English versions are available.
Third, during the organization of materials, the editors thoroughly compare and verify some sources, especially translations of foreign legislation and international treaties. First, they ensure the novelty of the materials. Second, when using translated Chinese versions, they strive to maintain the authority and accuracy of the translations. Many regulations and treaties required significant time for the editors to recheck and translate.
Fourth, to reflect the progress of international private law research in China, this book preliminarily organizes and lists domestic papers and works on international private law from 1980 to 2002 as "appendices" after each chapter, facilitating further in-depth research for readers.
Additionally, for ease of reference and conciseness, the book includes a general index, a detailed index, an abbreviated index of cited literature, and an abbreviated index of legislation or model laws of various countries. Readers can use the general index to determine the distribution of relevant content, the detailed index to find the page numbers of the required materials, and then follow the page number references to locate the specific materials. It is worth noting that all individual doctrines of scholars and different legislation and cases in this book are listed in the detailed index.
When using this book, readers should pay special attention to the following points:
1. The book uses an "abbreviated index of cited literature," which abbreviates the names of works and other materials into simpler terms. Readers can use this index to find the full information of the cited materials.
2. The book uses an "abbreviated index of legislation or model laws of various countries," which simplifies the international private law legislation of each country to the names of the countries. Readers can use the aforementioned index to find the full titles of the regulations.
3. The materials cited in the book are as faithful to the original text as possible. If the original text contains obvious errors, the editors will add the correct content in parentheses and mark it with the note "Editor's Note."
4. Due to technical considerations in typesetting, the book has reorganized the numbering of annotations in the cited original texts, but the content of the annotations itself remains largely unchanged.
