Features: The National Intellectual Property Administration of China, as the administrative department for patents under the State Council, entrusts the National Intellectual Property Administration Patent Office (hereinafter referred to as the Patent Office) to accept and examine patent applications and make various decisions in the name of the National Intellectual Property Administration. The National Intellectual Property Administration establishes the Patent Reexamination Board, which is responsible for reviewing and deciding on reexamination and invalidation requests. In order to handle patent applications and requests objectively, fairly, correctly, and promptly in accordance with the law, the National Intellectual Property Administration formulates this Patent Examination Guide (hereinafter referred to as this Guide) based on Article 121 of the Implementation Rules of the Patent Law. This Guide is the specificization of the Patent Law and its Implementation Rules, and therefore serves as the basis and standard for the Patent Office and the Patent Reexamination Board to administer the law, as well as the regulations that parties involved must comply with in the aforementioned stages.
