Features: Criminal law is one of the fundamental laws of the state. It plays an extremely important role in punishing crimes, protecting the people, maintaining social stability, and ensuring the smooth progress of socialist construction. Criminal law is a science that studies criminal law, and the prosperity or decline of criminal law research has significant theoretical and practical value in promoting criminal legislation and criminal justice, guiding the correct understanding and application of criminal law. On March 14, 1997, the fifth session of the eighth National People's Congress passed the revised "Criminal Law of the People's Republic of China" and it came into effect on October 1 of the same year. In the nearly three years that followed, the country launched a campaign to study and promote the new criminal law, publishing hundreds of textbooks, monographs, and popular reading materials, which played an important role in annotating and understanding the legislative intent of the criminal law articles, researching new theories of criminal law, establishing a new perspective on criminal law, and promoting the application of the new criminal law. With the development of the country's political economy, in order to punish crimes that disrupt the order of the socialist market economy and gradually improve the need for criminal legislation, the Standing Committee of the National People's Congress passed the "Decision on Punishing Crimes of Fraudulently Purchasing Foreign Exchange, Evading Exchange Regulations, and Illegally Trading in Foreign Exchange" on December 29, 1998, and the "Amendment to the Criminal Law of the People's Republic of China" on December 25, 1999. On April 29, 2000, the Standing Committee of the National People's Congress also passed the "Interpretation of the Second Clause of Article 93 of the Criminal Law of the People's Republic of China." At the same time, in the nearly three years after the revision of the criminal law was promulgated, the Supreme People's Court and the Supreme People's Procuratorate successively issued dozens of judicial interpretations based on theoretical and practical issues that arose during the implementation of the criminal law. We wrote this "Criminal Law" based on the basic theory of criminal law and criminal law norms, supplemented by revised decisions and judicial interpretations, and drawing on the research results of scholars at home and abroad and judicial practical experience. The "Criminal Law" is divided into three parts: the upper part (General Theory), which mainly studies the basic principles of criminal law, crimes, criminal liability, and the basic theory of punishment; the middle part (Special Theory), which mainly includes an overview of the criminal law division and the constitutions of crimes such as crimes against national security, as well as the boundaries in identification and application principles; the lower part (Special Theory), which mainly studies the constitutions of crimes in the other five categories, the boundaries in identification, and the principles of applying punishment. Due to the large number of crimes in the special theory and the complexity of the issues, it occupies a larger portion of the book. Things are constantly developing and changing, and legal theory is also advancing. The development of academia is the cumulative process of the hard work of millions of scholars. Not only must each generation inherit the academic achievements of the previous generation, but even within the same generation, later scholars must draw on the achievements of those who came before them to build upon them and make progress. The authors who participated in writing this book may have shortcomings in their understanding of the criminal law field and may not have contributed appropriately. This book is edited by Professor Zhao Changqing, who is a member of the Administrative Committee of the China Criminal Law Society, a member of the China Education Association, the president of the Criminal Law Professional Committee of Chongqing, and has written more than thirty criminal law textbooks and monographs.
