Author: Research Office of the Supreme People's Court
Publisher:
Publishing Date: 2006-03-01
Features: This book is selected and compiled by the Research Office of the Supreme People's Court, serving as an organized collection of newly issued judicial interpretations of the Supreme People's Court. It combines authority, comprehensiveness, practicality, and timeliness. A highlight of this series is the Understanding and Application Guidelines written by the drafters of the judicial interpretations. This book strives to highlight the following two characteristics:
1. Emphasizing the comprehensive collection of relevant materials. Previously published similar books often focused solely on judicial interpretations, neglecting the collection of judicial interpretive documents and normative documents for judicial work, or failing to collect them fully, making it difficult for readers to grasp the full picture of judicial documents from the Supreme People's Court. Considering that judicial interpretive documents and normative documents for judicial work also play an important guiding and reference role in judicial practice, we have included them in this book during the editing process.
2. Paying attention to the explanation and elaboration of relevant materials. In recent years, legal application issues have become increasingly prominent in judicial practice, and judicial interpretations have garnered growing attention. Relevant departments and society have also called for the Supreme People's Court to strengthen its judicial interpretation work. To help courts at all levels and accurately understand the content of judicial interpretations, articles written by judges who drafted the specific judicial interpretations, explaining the background and process of drafting, basic content, targeted matters, and relevant policy and legal boundaries, are typically published in relevant newspapers and periodicals alongside the release and implementation of judicial interpretations. These articles serve as valuable references for understanding and studying judicial interpretations, which we believe will benefit readers. In 2005, the Supreme People's Court issued 15 judicial interpretations and 32 judicial interpretive documents and normative documents for judicial work. Among these judicial interpretations, some are of great significance, such as "The Supreme People's Court on Issues of Applicable Law in Cases Involving Contract Disputes over State-owned Land Use Rights" and "The Supreme People's Court on Several Issues Concerning Disputes over Letters of Credit." Providing readers, especially legal professionals, with relevant authoritative reference materials in a timely manner will help them fully understand these judicial interpretations.
