Public law

Author: (Italian) Scibani, edited by Zhang Lihong, translated by Zhang Lihong
Publisher:
Publishing Date: 2000-03-01
Features: The content covered in this book is Roman Public Law, which is quite different from the previously published volumes. In the earlier volumes, Roman Public Law was only discussed in the first part of Book I on the sources of law and the second part of Book VI on criminal acts. The reason for compiling the content of Roman Public Law into a separate volume is to present the rich content of Justinian's "Corpus Juris Civilis" more broadly and comprehensively. Indeed, since the 11th century, when scholars from the University of Bologna "rediscovered" the "Corpus Juris Civilis," more research has focused on its private law norms. On the other hand, over the centuries, many jurists and political figures have attached great importance to the vast public law norms it contains, striving to eliminate privileges and inequalities in civil status as stipulated in feudal and customary laws. The rise of natural law and modern civil law codification, followed by the unfortunate syncretism movement, once narrowed the study of Roman law to its private law norms, creating the illusion that the "Corpus Juris Civilis" only included private law content.
