Features: Criminal law research must be oriented towards practice. The theoretical research outcomes should broaden people's professional horizons, and by revealing and grasping the spirit of legislation, it can promote criminal justice. At the same time, through active and in-depth criminal justice activities, the existing legislation and criminal law theories can be further practiced, enriched, and developed. Therefore, criminal law research and criminal legislation and justice are always mutually promoting and enhancing each other. Any idea that neglects theory or undervalues practice is irrational and quite harmful. Theoretical scholars should face reality more directly, answer and solve new practical issues; while practitioners should think more theoretically, be good at grasping and analyzing problems from a macro-principle and overall direction, and correctly select solutions. The four editors who participated in writing this book have all received rigorous and standardized legal training. They all graduated from East China University of Political Science and Law in Shanghai, most of them with master's degrees in criminal law, with solid theoretical foundations. At the same time, they have all worked in the courts and procuratorates of Shanghai, engaging in criminal adjudication and procuratorial practice, with extensive attention and reflection on many issues in criminal law reform and criminal justice. Therefore, they have collaborated to explore more than 20 topics in criminal theory, criminal legislation, and actual justice. This book is a result of the editors' preliminary reflections on relevant issues in contemporary Chinese criminal law.
