With the establishment of the principle of a socialist rule of law state and the development of a socialist market economy system, an increasing number of social and economic relationships require legal means for regulation. To this end, the national legislative body has successively promulgated and implemented a series of important laws, while national administrative organs and judicial organs have issued a substantial number of administrative regulations, departmental rules, and judicial interpretations. China has also concluded or participated in many international conventions. Due to the wide range of these legal norms, their multiple levels, large volume, and frequent amendments, revisions, and abolitions, legal practitioners face numerous difficulties when retrieving and applying the specific provisions of relevant laws and regulations.
In light of this, we have organized experts from the Supreme People's Court, relevant ministries and commissions of the State Council, and universities to compile this "Common Legal Decomposition and Application Integration Series." This series breaks away from the traditional listing format of legal compendia and adopts a classified compilation method. Taking commonly used laws as the main framework, it decomposes and combines the provisions based on their logical connections into specific legal issues. Relevant laws, regulations, departmental rules, judicial interpretations, and legislative explanations related to each issue are all compiled together, enabling readers to quickly locate all relevant legal provisions pertaining to the issue. This approach transforms the extensive legal provisions into an interconnected, organically integrated, and conveniently applicable whole.
The relevant laws, regulations, and departmental rules included in this book are presented in full or excerpted, depending on the circumstances. When multiple issues involve the same document (or the same legal provision), they are appropriately repeated under their respective categories to reduce the inconvenience of searching and flipping through pages. Documents that are not suitable for decomposition are arranged together with the more significant issues they concern. For less significant issues that also involve them, the "See" method is used.
