This book introduces the more commonly accepted concept and classification of legal documents. Broadly speaking, legal documents refer to all documents that possess legal effect and legal significance. Overall, they are divided into two parts: normative legal documents and non-normative legal documents.
Normative legal documents, also known as legislative documents, refer to laws promulgated by legislative bodies in accordance with law and regulations formulated by national administrative organs within their legal authority. They are behavior norms with universal significance, applicable to all individuals and entities. Non-normative legal documents, also known as practical legal documents, refer to the legal documents and case-related documents with legal effect or legal significance that are legally prepared by public security organs (including national security organs), procuratorates, courts, prisons, or labor reform agencies, as well as notarized documents, arbitration documents, and legal documents written or drafted by parties, lawyers, and law firms, which possess legal effect or legal significance. These include judicial documents legally prepared by judicial organs, notarized documents issued by notarizing organs, arbitration documents drafted by arbitration organs, and legal practice documents drafted or used by lawyers. The creators of these documents include not only various judicial organs and law-enforcement agencies authorized by law but also case parties, lawyers, and law firms. The legal documents we commonly refer to are non-normative legal documents, and this book primarily discusses this type of legal document.
