American Model Penal Code and its Annotations

Publication Date: 2005-11-01
Features: Each of the fifty states and the federal government in the United States has its own criminal code, and each is different from the other fifty. However, two-thirds of the criminal codes are based on the American Law Institute's "Model Penal Code." The "Model Penal Code" reflects the current state of American criminal law, making it difficult for any other criminal code to match its level. Over the past two decades, American substantive criminal law has undergone extensive revisions and codification efforts. The "Model Penal Code" completed by the American Law Institute in 1962 played a significant role during this period. It can be said that the laws of the vast majority of states were formulated under the influence of the positions taken by the "Model Penal Code." The goal of the American Law Institute in creating the "Model Penal Code" was also to promote the legislative process and assist in its implementation. The initially published "Model Penal Code" included only thirteen "provisional drafts," the initial "final draft," and the "formal draft of the entire code." Due to high demand, it was frequently reprinted. Considering that the annotations section had been appropriately updated over the past decade, the American Law Institute initially envisioned publishing an in-depth final version. However, this work was postponed because a more challenging project was supported—revising and expanding the annotations to explore and reflect the broad responses of the legislative and judicial branches to the "Model Penal Code." It can be observed that the general rules of the "Model Penal Code" address more and broader criminal law issues. In recent years, the recognition gained by these rules in a large number of legislative and judicial activities has demonstrated the significant achievements of the "Model Penal Code." During the revision of the code annotations, it was important to publish a final, official complete text of the "Model Penal Code." Therefore, the purpose of this volume is precisely this. In this volume, the proposed text is accompanied by brief annotations, as well as references to the revised annotations' volume and page numbers, where detailed explanations can be found. The text of the "Model Penal Code" has undergone years of review by the council and the members of the annual meeting, while the annotations and annotations are the work of the reporters.
