Beyond and Conservative: Environmental Law Innovation from the Perspective of Sustainable Development

Features: The core of this research is to examine, analyze, and innovate environmental law theory and institutions from the perspective of sustainable development. This is not only the original intention of my research proposal but also the main thread and essence that runs through the entire study. This research focuses on the philosophical significance of sustainable development for environmental law theory. Starting from the reconstruction of the subject-object relationship in the perspective of sustainable development and the value orientation of "ecological anthropocentrism," it addresses the rationality argumentation dilemma in environmental law theory research and strives to alleviate the tension between "anthropocentrism" and "ecocentrism." Guided by "ecological anthropocentrism," it seeks institutional path obstacles to exclude "ecocentrism" within the legal framework. The "compromising nature" of sustainable development has been criticized by ecocentrists, but I believe that it is precisely this high-level "compromise" that provides an epistemological foundation for moving beyond the theoretical dilemmas of environmental law and establishing mechanisms for communication and coordination. For this reason, I have named the research outcomes of this project "Beyond and Conservative," intending to illustrate our positioning of the sustainable development perspective and the attitude and stance we take towards theoretical and institutional innovation in environmental law based on this foundation.
