Publish Date: 2005-03-01
Features: This book is one of the few works in China that focuses specifically on sports law issues. The author begins by analyzing the general legal relationship between sports and law, examining sports disputes from an academic perspective. Then, drawing on the common practices of sports law in developed countries in Europe and America, as well as the legal practices of the Court of Arbitration for Sport (CAS) and the European Court in handling international sports disputes, the author proposes a plan to establish and improve China's diversified sports dispute resolution mechanisms centered on sports arbitration.
With the progress and development of human society, sports have become an indispensable part of life. Whether it is mass fitness activities or competitive sports, disputes and conflicts will inevitably arise. How to learn from the common practices of foreign and international countries to improve China's sports dispute resolution mechanisms is a question worth in-depth research. Additionally, China's Beijing will host the 2008 Olympics, and how to establish a domestic sports arbitration system in China to align with the arbitration mechanisms of the Court of Arbitration for Sport (CAS) of the International Olympic Committee (IOC) also requires further research.
From an academic perspective, studying the resolution of sports disputes is meaningful for improving sports law, an interdisciplinary field combining sports science and legal science. Through an examination of the legal systems for sports dispute resolution in several typical countries (the UK, the US, Germany, Italy, Greece, the Netherlands, Japan, Belgium, and Sweden), as well as a study of the methods for resolving sports disputes in international legal practices (primarily the practices of the European Court and the Court of Arbitration for Sport), the book reveals the general legal principles and institutional patterns of sports dispute resolution. It attempts to design a diversified and reasonable mechanism centered on sports arbitration to resolve sports disputes in China.
