Features: The revision of the Criminal Law is most evident in the substantial increase of articles in the Specific Provisions of the Criminal Code, from the original 103 to the current 350. The increase in the number of articles in the Specific Provisions of the Criminal Code undoubtedly reflects the addition of specific offenses. According to the interpretation of specific offenses in the Criminal Law by the Supreme People's Court, there are over 400 specific offenses involved in the Criminal Law. Among these offenses, a considerable portion were not stipulated in legislation in the past. That is to say, whether for judicial practitioners or for legal theorists, some offenses are not even familiar, or even very unfamiliar. The practice of judicial work requires us to study and explore the various offenses stipulated in the Criminal Law, and analyzing cases is the best way to study these offenses.
To study the various specific offenses in the Specific Provisions of the Criminal Law and to give undergraduate students studying criminal law a practical understanding of the Specific Provisions, we have carefully selected 489 cases from the thousands of cases we have collected. Some cases include legal analysis, while others merely raise questions without any analysis, serving as material for reflection and discussion. The case analyses provided by the editors are interpretive in nature, and this should also be noted by the readers. Of course, due to limitations in our level and ability, although we strive to do better, there may still be unsatisfactory aspects. We hope that our colleagues will provide feedback so that we can make improvements. The Criminal Law is a highly theoretical and practical discipline in law. The theoretical nature of the Criminal Law is primarily reflected in the General Provisions, while its practical nature is more evident in the Specific Provisions. This book explains over 400 specific offenses related to the 10 categories of crimes stipulated in the Specific Provisions of the Criminal Law through case analysis. It holds certain reference value for law students, legal theorists, and judicial practitioners.
