Features: The study of tourism contracts has always been a relatively weak area in the field of legal research in China. This is highly incongruous with the rapidly developing tourism market in our country. It is also incompatible with the orderly, sound, and internationally aligned legal environment that China should possess after joining the WTO. Based on the fundamental principles and theories of contract law, and combining the tourism contract legislation, judicial practices, and relevant international conventions of representative countries/regions in the civil law system and the common law system, this paper starts with the legal nature of tourism contracts, striving to conduct an exhaustive and in-depth research on the important issues and substantive content of the legal relationships in tourism contracts. It also proposes some positive suggestions on how China can construct relevant systems, hoping to provide theoretical and practical support for the establishment of a tourism contract system with Chinese characteristics in China.
