Research on Quasi-Right

Author: Cui Jianyuan

Publish Date: 2003-04-01
Features: The conception and writing of this book were accidental, arising from the gradual completion of the author's academic papers on mineral rights, water rights, and fishing rights. Most of the content of this book on quasi-property rights was thus naturally prepared. The general theory of quasi-property rights, abstracted and elevated from mineral rights, water rights, fishing rights, and hunting rights, was also inevitable. The inquiries from peers and students about concepts such as quasi-property rights, along with the debates on many issues, acted as a catalyst, accelerating the author's systematic elaboration of the quasi-property rights system and its theories. The objects of quasi-property rights involve natural resources and even the natural environment. The term "natural resources," as used by the pioneer of vulgar economics, Say, was replaced with "nature," encompassing not only inanimate objects that contribute to value creation but also natural laws such as gravity that makes pendulums swing, magnetism that directs compasses, the gravity of the atmosphere, the self-igniting property of heat, and so on. This book includes: Preface, Conceptual Analysis of Quasi-Property Rights, Comparative Analysis of Quasi-Property Rights and Related Property Rights, Acquisition of Quasi-Property Rights, Transfer of Quasi-Property Rights, The Legal Effects of Quasi-Property Rights, and the Termination of Quasi-Property Rights.
