Features: Research and investigation are the foundation of scientific decision-making and an important guarantee for the effective implementation of various tasks. In recent years, the work of the capital's courts, like other fronts, has faced an endless stream of new situations and problems. Especially with the implementation of the "New Beijing, New Olympics" strategic concept and the historical mission of building a "paradigm of a harmonious socialist society," our judicial capabilities, trial methods, and working mechanisms have faced new challenges. The resolution of deep-seated issues and contradictions in judicial work, the overall improvement of judges' judicial skills, and the improvement of the judicial environment all urgently require us to conduct comprehensive analysis and grasp the trends of development through research and investigation, providing theoretical support and proposing practical and effective solutions. Therefore, strengthening research and investigation in judicial work is an inevitable requirement for the capital's courts to strive to achieve the theme of "Justice and Efficiency," practice the principle of "Judiciary for the People," and build a "paradigm of a harmonious socialist society."
Currently, we are in a special period marked by sudden internal conflicts among the people, intense struggle against enemies, high rates of criminal offenses, and growing public demand for the rule of law. Some old conflicts continue to accumulate, while deep-seated contradictions that constrain the overall situation gradually come to the surface, making the task of building a harmonious socialist society particularly arduous. Adapting to changes in the situation, the capital's courts have not only expanded their role from primarily enforcing punishment to encompassing multiple functions such as punishing crimes, safeguarding rights, resolving conflicts, ensuring development, and promoting administrative governance in accordance with the law. Moreover, various types of trials have shown new characteristics: First, cases with strong political sensitivity and significant social impact have. Second, new types of cases are constantly emerging. The types of cases handled by the courts exceed 500, nearly involving all aspects of the capital's development. Especially after China's entry into the WTO, administrative cases such as trademark and patent disputes have been uniformly subjected to judicial review and are handled exclusively by Beijing courts, increasing the difficulty of trial. Third, the unique geographical and political characteristics of the capital determine that cases involving central government departments, central government-owned enterprises and institutions in Beijing are all handled by local courts. In addition, in accordance with the designation of the Supreme People's Court, many major cases with significant national impact involving corruption crimes are also handled by Beijing courts. Fourth, collective disputes remain high. Disputes involving housing demolition, laid-off workers, and the interests of farmers have risen dramatically.
The constant emergence of new situations and problems has both posed severe challenges to judicial work and provided the courts with unique advantages for research and investigation. In 2004, courts at all levels in the city focused on the core of adjudication, primarily conducting applied research. Based on the characteristics and realities of the capital's judicial work, with new ways of thinking and new methods, they conducted effective research and investigation on prominent issues in adjudication and execution, reform of trial methods, and team building. Among these, a number of high-quality research findings on building a "paradigm of a harmonious socialist society" played a positive role in easing social conflicts, regulating social relationships, and promoting the development of the capital. Research findings on fully maintaining the safety and stability of the capital and society were highly commended by relevant leaders. Research findings on major issues related to the macro-decision-making and long-term development of the courts also actively promoted and facilitated the strengthening of judicial self-construction and the legal protection of the rights and interests of parties.
Only by timely transforming and utilizing research findings can they fulfill their intended role, demonstrating their value in serving leadership decision-making and judicial reform and adjudication. In recent years, although many research findings of the capital's courts have attracted high attention from Party and government leaders and higher courts, some have been directly transformed into measures to strengthen judicial work and guidelines for adjudication, while others have provided references for the formulation of judicial interpretations by the Supreme People's Court and for the formulation of policies and regulations by other departments. However, as a whole, the transformation and utilization of research findings still need to be continuously strengthened. This collection of outstanding research reports from courts across the city in 2004 aims to improve the transformation and utilization of research findings, expand their application scope and social influence, and better serve the overall development of the capital, leadership decision-making, and all aspects of judicial work in the capital's courts. At the same time, it also hopes to inspire the research enthusiasm of judicial personnel across the city, create a strong learning and research atmosphere, and promote the in-depth development of all judicial work.
Research and investigation are the foundation of planning and the path to success. It is hoped that courts across the city will further strengthen the organizational leadership of research and investigation, treating it as a fundamental task for the overall development of the courts. With an eye on the overall situation and grounded in the realities of the courts, they should further intensify research efforts, expand the depth and breadth of research, and strengthen the transformation and utilization of research findings, making research work more closely aligned with adjudication, judicial reform, and team building. The process of research and investigation is also a process of learning, thinking, and improvement, as well as a process of identifying problems, keeping pace with the times, and continuously strengthening and improving work. All judicial personnel, especially leaders, should be grounded in the key task of serving the development of the capital, combined with the actual work of courts across the city, and further explore new ideas, methods, and measures to strengthen and improve all aspects of work. Through extensive and in-depth research and investigation, they should,,, and strive to provide strong legal guarantees for building a "paradigm of a harmonious socialist society."
