Features: As a planned teaching material for higher political and legal colleges under the Ministry of Justice, this textbook has been well-received by readers since its publication and has made significant contributions to the legal education. However, with the development of the times, the innovation of concepts, and the changes in laws, the textbook has inevitably been revised. The textbook was first published in 1994, and some revisions were made in 1997 according to the new 《Criminal Law》, but the basic framework was largely retained. With the passage of time, today's systematic revision has already entered the 21st century. Although the time span is just a few years, the development of China's criminal law during this period has been remarkable. For example, criminal law amendments have become a common method of legal revision, legislative interpretations have been given further attention, and a large number of new judicial interpretations have been issued, and so on. These criminal law phenomena are manifestations of the further standardization and specification of China's criminal law in the era of rule of law and the principle of criminal law. As a result, China's criminal law has gained new growth space.
In terms of the revision process of this textbook, it is first an inheritance. Cultural transformation is gradual, and so is human cognition. The principles of criminal law have a long history, and the concepts of criminal law are profound, all of which are the results of inheritance and development. This textbook not only inherits some excellent features of the original textbook, such as the rigorous explanation of legal provisions, the authoritative requirements for viewpoints, and the collection and application of common views, but also inherits the reasonable content of the inheritance of criminal law concepts. It is precisely these rationalities that determine why we choose to revise rather than start from scratch.
Secondly, it is a development and innovation. The characteristics of the textbook itself also determine that we must closely follow the pulse of the times, according to the needs of social and rule-of-law development, and according to the practical requirements of the law, to delete outdated content, absorb developed theories, summarize and analyze newly added provisions, and provide targeted explanations and interpretations of legal application.
