Features: Internationally, although there is no unified understanding of the enforcement effectiveness of the "Antitrust Law," it can be seen from some countries referring to it as the "Great Charter of Free Economy" (USA), "General Outline of Market Competition Order" (Germany), and "Economic Constitution" (Japan) that they attach great importance to this legal system. Since the United States enacted the Sherman Antitrust Act in 1890, the history of global antitrust has spanned over a century. Today, major developed countries worldwide have their own legal systems to protect competition, and more than 100 countries globally have enacted antitrust laws. Issues such as economic monopoly and administrative monopoly are widespread in China, and calls for their resolution are growing. However, China still lacks a dedicated Antitrust Law or an independent antitrust enforcement agency, nor does it have effective operational procedures. This gap has created a significant legal void, making it difficult to fully and effectively protect the market competition mechanism, which is highly unfavorable to the operation and development of China's socialist market economy. Based on vivid language, typical cases, a profound historical foundation, and solid economic and legal analysis, this book examines the historical process and development trends of global antitrust moving from domestic to international levels and proposes reasonable framework suggestions for China's scientific antitrust approach. The content is both engaging and thought-provoking. The book is divided into three parts:
Part 1: "Economic and Legal Analysis of Monopoly and Antitrust" primarily analyzes the formation of domestic monopolies in developed countries, the efficiency losses caused by monopolies, the types of monopolies regulated by antitrust laws, the benefits and costs of antitrust, legal analysis of antitrust, and the challenges faced by antitrust.
Part 2: "Global Antitrust Trends and Development Directions" studies the development and refinement of global antitrust over more than a century through the analysis of typical antitrust cases and judgments. It explores changes in the focus, perspective, starting point, and control methods of antitrust regulation, as well as its development trends, providing a foundation for analyzing dynamic countermeasures for China's antitrust in the context of economic globalization.
Part 3: "China's Antitrust Practice Driven by the Global Wave of Antitrust" analyzes China's monopoly status and causes, reforms in monopoly industries, the monopoly status of multinational corporations in China, and how to learn from international experience to construct China's antitrust economic and legal system.
This book can serve as a reference for government officials, university and college teachers and students, and is particularly suitable for economists, legal professionals, and researchers in theory and policy. The "Antitrust Law" has beened in China for over a decade and is about to be officially enacted. This book is intended as a gift for this significant event.
