Administrative Litigation Law -(Revised Edition 2007)

Author: Ying Songnian
Publisher:
Publishing Date: 2007-09-01
Features: In the preface to the "2nd Revised Edition" in 2001, the author stated, "With the new developments in litigation practice and theoretical research, we should write a new edition again." Four years later, another revision is being made for the 3rd time, which reflects, from one side, the rapid development of administrative rule of law in our country. During this period, the "Administrative Licensing Law," the State Council's "Implementation Plan for Comprehensively Advancing Rule of Law in Administration," the Supreme People's Court's "Provisions on Several Issues of Evidence in Administrative Litigation," and other judicial interpretations were successively promulgated; new administrative and judicial practices have raised many new issues that need theoretical exploration and answers; through the joint efforts of theorists and practitioners in administrative law and administrative litigation law, significant new progress has been made in the theoretical research of administrative litigation; it should also be noted that in recent years, due to the rapid development of administrative and judicial practices in our country, calls for revising the Administrative Litigation Law and the State Compensation Law have grown increasingly louder, and the timing has become increasingly ripe, with consensus forming in some aspects. All these have been thoroughly studied during the revision of this book and efforts have been made to fully reflect them in the revised edition. When the book was first compiled, the authors agreed that it should meet the needs of teaching practice by providing as complete as possible the latest research findings and new development information; based on the provisions of laws, regulations, and judicial interpretations, explain the basic rules of the operation of China's administrative litigation system; answer new issues raised by theoretical research and practice, and when dealing with controversies related to administrative litigation, present our views, but strive for clear and concise arguments, leaving necessary space for readers and users. This revision still adheres to this principle. The "4th Edition" has also added content summaries and learning objectives and requirements at the beginning of each chapter, as well as discussion questions and reference bibliographies at the end. The authors and their respective responsibilities for the "4th Edition" remain the same as those for the 1st and 2nd editions.
