Features:
The interpretations and requests for guidance from the Supreme People's Court and the Supreme People's Procuratorate play an indispensable role in ensuring the correct application of the law and the smooth progress of judicial work. We have integrated the currently effective interpretations and requests for guidance into four volumes: Civil Volume, Commercial Volume, Criminal Volume, and Administrative·State Compensation Volume, for reference by staff in judicial practice departments. The features are as follows:
Comprehensive and Practical
We strive to comprehensively include the currently effective judicial documents of the Supreme People's Court and the Supreme People's Procuratorate, including internal reference documents and case-specific approvals. Although these internal reference documents and case-specific approvals may not be universally applicable, they represent the stance of the Supreme People's Court and the Supreme People's Procuratorate in handling specific cases or applying the law during a certain period. They serve as supplements to the then-existing law or interpretations and hold significant reference value. Additionally, we have included some legal documents closely related to judicial documents (e.g., the General Principles of the Civil Law of the People's Republic of China) and appended them after relevant judicial documents for systematic reference.
Scientific Format
The documents are divided into several subcategories, and within each subcategory, judicial documents are organized by Interpretations, Requests for Guidance, and Related Legal Links. The principle of organization is as follows: According to the "Provisions of the Supreme People's Court on Interpretation Work" and the "Interpretation Work Provisional Regulations of the Supreme People's Procuratorate," judicial documents of the Supreme People's Court are divided by the boundary of July 1, 1997, and judicial documents of the Supreme People's Procuratorate are divided by the boundary of December 9, 1996. Judicial documents issued before the boundary are generally included in the Interpretations category, except those titled "Telephonic Replies." Judicial documents issued after the boundary are generally included in the Requests for Guidance category, except those titled with "Interpretation," "Regulation," "Approval," "Notice," or "Opinion." Within the same subcategory, Interpretations or Requests for Guidance are arranged by issuance date to facilitate readers' searches.
