Features: In recent years, with the continuous acceleration of urban economic construction, the number of urban housing demolition cases has increased rapidly. As a result, the number of cases involving demolition arbitration, administrative reviews, and administrative litigation has grown year by year. Urban housing demolition cases have become hot and difficult issues in urban construction law enforcement and administrative litigation. Properly handling urban housing demolition cases in accordance with the law is of great significance for ensuring the smooth progress of economic construction and protecting the legitimate rights and interests of the parties involved. In July 2002, the Supreme People's Court decided to initiate the work of drafting the "Regulations on Several Issues Concerning the Adjudication of Administrative Cases Involving Urban Housing Demolition." To make the judicial interpretation more ( does not need translation, return as is) and address practical problems, the Supreme People's Court's Administrative Trial Tribunal commissioned the Administrative Trial Tribunal of the Jiangsu High People's Court to conduct preliminary research and drafting work. After accepting this task, the Administrative Tribunal of the Jiangsu High People's Court, in conjunction with the Legal Affairs Office of the Provincial Department of Construction and the Urban Real Estate Industry Office, visited some cities and counties for demolition cases. With the rapid development of China's economy and the acceleration of urban construction, the number of urban housing demolition cases has surged, leading to an increase in demolition conflicts and disputes. Some of these involve issues related to government actions, while others exist due to government functional misalignment or overreach, and some involve demolition compensation and resettlement issues. All these problems are both broad and detailed. If they are not resolved properly, it may lead to intensified conflicts between demolitioners and demolitionees, triggering disputes. For this reason, this book identifies problems from actual demolition work and absorbs experience, hoping to provide a good mirror for administrative personnel engaged in this field and readers involved in demolition cases.
