Features: This book is co-authored by Ruan Fangmin (Professor at the Law School of Zhejiang University, Ph.D. in Law) and Wang Xiao (Lecturer at the Law Department of Zhejiang Sci-Tech University). It is the final outcome of the project "Countermeasures for Punishing and Preventing Organized Crime of the Nature of a Triad" supported by the Fang Keqiang Fund of Zhejiang University in 2002 (Project No.: 2031101-581105). The book is divided into two parts. The first part, "Theories of Prevention and Control of Organized Crime," employs multidisciplinary knowledge such as philosophy, sociology, psychology, biology, economics, and criminology to discuss the causes and prevention of organized crime, with a particular focus on the causes and prevention of organized crime in China. The second part, "Theories of Punishing Organized Crime," applies legal theories to study how legislation and judicial practice can accurately punish organized crime of the nature of a triad, especially by linking to the recently enacted legal provisions of the "United Nations Convention against Transnational Organized Crime" to explore the improvement and perfection of China's legal norms for punishing such crimes. The book proposes numerous innovative viewpoints and suggestions in various aspects, including the analysis of the causes of organized crime, the construction of prevention strategies, the boundaries of judicial punishment for organized crime of the nature of a triad under China's current legal norms, and the legislative improvements for China as a contracting state to the "United Nations Convention against Transnational Organized Crime" to fulfill its international legal obligations. These viewpoints and suggestions hold significant reference value for the legislation and judicial practice of preventing and punishing organized crime of the nature of a triad in China. To assist readers in reviewing the legal norms discussed in the book regarding the prevention and punishment of organized crime, the book includes appendices of China's criminal provisions for punishing organized crime of the nature of a triad, relevant judicial interpretations and legislative interpretations, the "United Nations Convention against Transnational Organized Crime," and the decision of the Standing Committee of the National People's Congress to ratify China's accession to the Convention.
