Western Constitutional System (Volume 2: European Constitution) (Second Edition)

Author: Zhang Qianfan
Publisher:
Publish Date: 2005-12-01
Features: As the European Constitution is destined to be formally established sooner or later, this book will also inevitably undergo a "split": the European Constitution and the Convention on Human Rights will stand alone, like the U.S. Constitution, forming a complete European constitutional system together with the constitutions of member states. Although the ultimate goal of constitutional governance in all countries is consistent, the European Constitution still demonstrates a different evolutionary path compared to the U.S. Constitution. Just in terms of the common approach to achieving European unity, it offers thought-provoking insights. In this sense, the reference value of European constitutionalism for China may even exceed that of U.S. constitutionalism. Currently, the Treaty on European Union remains uncertain, so this book retains its original structure, with the Convention on Human Rights separated into an independent chapter. However, this also means that the book's length faces the same challenges as the first volume, despite the expanded format. Due to the need to supplement a significant amount of material and the lack of chapters to delete, the literature compilation in the appendix has been omitted, while selected constitutional provisions are retained.
