Features: Modern economy cannot be separated from the market. A market economy is essentially a transaction economy. To market prosperity, it is necessary to stimulate transactions. In a highly competitive market, facing complex market entities and diverse value orientations, ensuring the freedom, equality, security, and reliability of transactions relies not only on the overall level of business ethics in society but also on the establishment of comprehensive and authoritative transaction rules. Thus, the contract law emerged. Contract law governs market transaction behaviors, pursues the honesty and good faith of human nature, promotes the spirit of human cooperation, and builds the two civilizations of society. Therefore, the contract system is not only the basic system of the market economy but also an important cornerstone for the orderly development of society. Since the new Contract Law took effect on October 1, 1999, and the original Economic Contract Law, Foreign-related Economic Contract Law, and Technology Contract Law were simultaneously abolished, the author has given dozens of lectures to officials from government agencies, enterprises, and public institutions. On the one hand, the audience has given enthusiastic encouragement, and on the other hand, they have hoped that the lectures could be compiled into a book. For this reason, the book "Principles and Operations of Contract Law" was written, with the hope of contributing a small part to help citizens, legal persons, or other organizations protect their rights and achieve new brilliance.
This book highlights three aspects:
1. Simple and Easy to Understand. The book strives to explain legal professional terms in relatively simple and easy-to-understand language, using concise and clear text to clarify contract principles, enabling readers to grasp the key points at a glance in their practical work.
2. Focus on Practicality. Contract law is the law that regulates market transaction behaviors. To ensure that the contract law of readers is legal, appropriate, and reasonable, it is essential to emphasize practicality and usefulness. This book takes the readers' perspective, based on practice, to clarify the principles to be adhered to, the conditions to be met, and the procedures to be followed in actual operations.
3. Global Perspective. The book briefly introduces relevant contract systems in certain sections, including the "United Nations Convention on Contracts for the International Sale of Goods," the "International Commercial Contracts," as well as the contract systems of common law and civil law countries.
