Features: To systematically introduce e-commerce law, it is necessary to address fundamental questions such as what e-commerce and e-commerce law are, what the basic systems of e-commerce law are, and how e-commerce information transactions are conducted. Therefore, this book is divided into three parts. The first part consists of Chapter "Overview of E-commerce Law," which discusses the question "What is e-commerce and e-commerce law." The second part is composed of Chapters 2, 3, and 4, which explore the question "What are the basic systems of e-commerce law." The third part, Chapters 5, 6, and 7, elaborates on "How e-commerce information transactions are conducted." There is a certain connection between the three parts of this book. The first part is the general theory of e-commerce law, discussing fundamental issues such as the objects of regulation, basic principles, and characteristics of the law. The second part introduces the basic systems of narrow e-commerce law, including data communications, electronic signatures, and electronic authentication. Since these all discuss e-commerce transaction forms and are related to transaction procedures, they can be collectively referred to as e-commerce procedural norms theory. The third part addresses issues related to the substantive relationships in e-commerce transactions, equivalent to the specific topics of e-commerce law. This section could have included much more content, but due to space and time constraints, only topics with e-commerce characteristics, such as electronic information transactions and electronic payments, are discussed.
Due to the fact that the legislation and research of e-commerce law have just begun in China, there is still a lack of rich theoretical preparation and practical experience. While introducing domestic legislation and drafts, this book will also analyze and discuss e-commerce legal documents from international organizations and foreign countries to identify some patterns. However, e-commerce law is a completely new field of commercial law. From the basic concepts of e-commerce law to specific systems and even its theoretical framework, there are no existing doctrines or well-developed legislation to refer to. Therefore, if readers can gain a general understanding of the concepts and basic systems of e-commerce law through this book, the author will be very pleased.
