Features: There has always been a lack of a comprehensive manual for adjudicating labor dispute cases in the practice of labor dispute adjudication. Court judges not only find it difficult to retrieve relevant information when handling cases and applying laws, but also face certain difficulties in identifying and understanding conflicts, effectiveness, and other issues among labor dispute laws and regulations due to a lack of editing and organization. To address these situations and improve the efficiency and quality of labor dispute adjudication by courts, we reviewed a large amount of material and conducted focused research. After more than a year of writing and revision, we finally compiled this labor dispute adjudication manual——《Practical Guide to Labor Dispute Adjudication》.
The Practical Guide to Labor Dispute Adjudication is a collective effort that combines issues encountered in judicial practice, based on relevant laws, regulations, and judicial interpretations. It incorporates the adjudicative experience of peers and extensive feedback, divided into two main parts: the Q&A section and the Legal section. The Q&A section adopts a question-and-answer format to briefly outline basic substantive and procedural issues in labor dispute cases, and proposes solutions and handling approaches for certain difficulties. The Legal section includes common laws, regulations, judicial interpretations, departmental rules, and normative documents from provincial labor bureaus, as well as a compilation of their effectiveness, to facilitate judges in retrieving and applying laws and regulations.
