Regarding working hours, according to relevant laws and regulations of the country, employees are required to work 8 hours a day and 40 hours a week. If a company needs to extend employees' working hours due to production or operational requirements, it must not exceed 1 hour per day after consulting with the trade union and employees. For special reasons, under the condition of ensuring employees' physical health, it may not exceed 3 hours per day and 36 hours per month. If the nature of the work or production characteristics prevents the implementation of the 8-hour daily and 40-hour weekly standard work system, other work and rest arrangements, such as flexible work hours, may be adopted, but they must be approved by the labor administrative department. Some companies require employees to work 6 days every other week or half days on Saturdays in the morning and do not pay overtime compensation for what they call "routine overtime," which is illegal.
Regarding overtime pay, if employees are required to work overtime due to company needs, the company should pay overtime compensation to employees according to the corresponding legal standards. As mentioned earlier, some companies have heavy workloads and tight deadlines, and they implement performance-based pay systems, forcing employees to voluntarily work overtime after work or on rest days to complete tasks. Some companies require employees to work overtime but arrange compensatory rest without paying overtime compensation. Some companies determine overtime pay based on a fixed rate set by the company, or use the basic wage or even the local minimum wage as the standard base for payment. Some companies stipulate that overtime pay is calculated only for a certain number of hours, and no overtime pay is given for hours exceeding that limit.
