The real estate industry in China is still relatively new, having only developed since the early 1990s and having existed for only a dozen years or so. Like other industries, its development has gone through a process from immaturity to gradual maturity. Currently, China's real estate industry is in the process of transitioning toward maturity. As the industry continues to develop, the laws and regulations governing it are gradually being improved and refined. The Urban Real Estate Administration Law of the People's Republic of China, passed by the Standing Committee of the Eighth National People's Congress on July 5, 1994, is the primary legal framework for urban real estate management in China. Subsequently, on July 20, 1998, the State Council promulgated the Regulations on the Administration of Urban Real Estate Development and Operation. Based on these laws and regulations, the Ministry of Housing and Urban-Rural Development and local real estate authorities have also issued a series of departmental rules and regulatory documents. However, it should be noted that China's current real estate laws and regulations are not yet as robust as those in developed countries.
Given the current state of real estate laws in China, there is a need for more research and discussion in theory to find practical solutions to the numerous legal issues arising in real estate practice. As lawyers, compared to other legal professions, we are at the forefront of legal practice, whether in non-litigation matters, litigation, or arbitration; whether in national or local legislation, or the issuance of government regulatory documents—all of these activities involve the participation of a large number of lawyers. It can be said that with the acceleration of China's rule-of-law process and the increasing legal awareness of the government and the public, lawyers' work has touched every aspect of society, and the real estate sector is no exception.
Additionally, over the past decade or so, the development of the legal profession has led to real estate legal services becoming one of the main areas of practice for lawyers. With more lawyers participating in real estate legal matters, an increasing number of lawyers are also focusing on researching real estate legal issues. Our book, Real Estate Development and Operation: Legal Practice, is divided into eight chapters: Chapter 1: Land Use Rights; Chapter 2: Real Estate Development; Chapter 3: Construction Projects; Chapter 4: Real Estate Transfer; Chapter 5: Property Rights Registration; Chapter 6: Property Management; Chapter 7: Real Estate Finance; Chapter 8: Real Estate Copyrights.
The purpose of compiling this book is primarily to facilitate communication among lawyers and to provide more professional legal services to all sectors of society. Since the authors completed their contributions to this book amidst their busy legal practices, the views expressed are merely personal opinions of the lawyers. It is inevitable that there may be omissions or contentious points in the book. Here, the editorial committee sincerely thanks those who have shown interest in this book and hopes that readers will provide valuable feedback on its shortcomings.
