1. Consumer Damage Disputes and Their Legal Characteristics
Consumer damage disputes refer to conflicts that arise between consumers and businesses due to the infringement of consumer rights. Consumer rights are the rights and interests that consumers legally enjoy when purchasing, using goods, and receiving services. The Consumer Rights Protection Law stipulates a series of rights that consumers should have when purchasing, using goods, and receiving services. The occurrence of consumer damage disputes may stem from the consumer's belief that the business's actions infringe upon their legitimate rights or from differing views between the consumer and the business regarding issues related to consumer rights, leading to disputes. From a legal perspective, such disputes fall under the category of civil disputes. Consumer damage disputes exhibit the following characteristics:
First, consumer damage disputes arise in the field of consumption or during the consumption process. According to relevant provisions of the Consumer Rights Protection Law, the specific scope of consumer damage disputes includes conflicts that arise between consumers and businesses when consumers purchase, use goods, or receive services for personal consumption needs; disputes that occur between businesses and consumers when businesses provide goods or services produced or sold by them; and disputes that occur between farmers and businesses when farmers purchase, use, or directly use production materials for agricultural production.
Second, consumer damage disputes are disputes concerning consumer rights or the obligations of businesses. The Consumer Rights Protection Law and the Product Quality Law, as well as other laws and regulations, grant consumers a series of rights, such as the right to safety, the right to be informed, and the right to fair trade. At the same time, they impose a series of obligations on businesses, some of which correspond to consumer rights, such as the obligation to ensure the safety of goods and services, the obligation to provide truthful information about goods and services, and the obligation to guarantee the quality of goods and services. Although consumer damage disputes vary greatly in practice—some arise from product quality issues, others from service pricing, and some even from mutual conflicts—their core revolves around rights and obligations. Behind goods and services lie consumer rights and business obligations. Consumer damage disputes are disputes concerning consumer rights and business obligations.
Third, consumer damage disputes have the nature of civil disputes. The legal relationship between businesses and consumers is generally of a civil nature. This is because the legal status of both parties is equal, and there is no subordinate relationship between them. Disputes with government administrative organs do not fall under consumer damage disputes. When the state provides services to consumers in the capacity of a civil entity, disputes may also arise between the state and consumers (e.g., disputes caused by unreasonable fees). In such cases, the state and businesses are in equivalent positions, and the disputes between them and consumers are of a civil nature, falling within the scope of consumer damage disputes.
2. Overview of Consumer Damage Claims
Although the Consumer Rights Protection Law is a specialized law focused on protecting the legitimate rights and interests of consumers, it is not the sole legal basis for consumer damage claims. When a consumer damage dispute occurs, consumers should first remain calm, preserve evidence related to the consumption event, such as purchase receipts, product advertisements, and commitments made by businesses; at the same time, they should clarify the legal relationship of the dispute, such as whether the consumption behavior, such as purchasing a house, should be governed by the Consumer Rights Protection Law as well as special provisions under real estate laws.
