Features: 2005 marked the 10th anniversary of the promulgation of the "Commercial Bank Law of the People's Republic of China" (hereinafter referred to as the "Commercial Bank Law"). After a decade of development, China's commercial banks have moved beyond the era of operating without legal frameworks and entered a new period in the banking industry characterized by "having laws to rely on, adhering to the laws strictly, enforcing the laws rigorously, and punishing violations severely." Over the past 10 years, the banking industry has achieved significant results in legal popularization, training, law enforcement inspections, and improving corporate governance. Today, the relationship between banks and customers has greatly changed compared to a decade ago. Bank staff are now more legally conscious and more cautious in their service actions than they were a decade ago. Most lawsuits involving commercial banks are cases where borrowers fail to repay principal and interest on time, or other lawsuits filed by banks to protect their claims. Participating in litigation has also allowed commercial banks to learn more legal knowledge and gain practical experience from real cases. On the occasion of the 10th anniversary, the author revisited and studied this law, combining the experiences and lessons of the past decade to rewrite the textbook on commercial bank law. The understanding of the law has become deeper than before, and the author's perspectives and insights on certain issues are also more comprehensive. Especially in terms of solutions to problems and expression methods, they are more in line with the actual conditions of China and more "Chinese-style."
