Each chapter includes several selected cases. Each case is composed of three parts: case introduction, legal issues, and legal analysis. The legal issues section highlights the main legal issues involved in the case, while the legal analysis section systematically and thoroughly analyzes the legal issues raised in the case, combining the case with the principles of criminal procedure law and criminal procedure legal norms. Criminal procedure law is an important procedural law that stipulates the powers and duties of public security organs and judicial organs in criminal procedure, as well as the procedural rights and obligations of parties and other procedural participants. It also defines the principles, systems, and specific procedures for conducting criminal procedure. The smooth progress of criminal procedure is related to the effective punishment of crimes and the stability of social order. Since criminal procedure concerns the rights of citizens' lives, freedom, and property, it must be strictly conducted in accordance with the statutory procedures to prevent the infringement of citizens' rights. In modern society, criminal procedure law holds equal importance for punishing crimes and protecting human rights.
On March 16, 1996, the Fourth Session of the Eighth National People's Congress amended the Criminal Procedure Law promulgated on July 19, 1979, further improving China's criminal procedure principles, systems, and procedures, as well as enhancing the democratic nature of the proceedings. Conducting criminal procedure strictly in accordance with the procedural provisions stipulated by the Criminal Procedure Law is undoubtedly the fundamental guarantee for the correct implementation of the law's tasks. While correct understanding of the provisions of the Criminal Procedure Law is the prerequisite for its correct implementation.
This book is a case textbook specially compiled to support the teaching of criminal procedure law, based on the current provisions of the Criminal Procedure Law. It should be noted that some content in the case analysis is interpretive in nature. During the compilation process, reference was made to some publicly published or published cases.
