Outline of the History of Chinese Legal Philosophy

Author: Liu Xin
Publisher:
Publish Date: 2005-10-01
Features: Philosophy of law is a discipline that observes and understands the social phenomenon of law from a certain philosophical worldview and methodology. The legal thoughts and theories of some major thinkers and representative figures in Chinese history are closely tied to their philosophical views on law. The author conducts an in-depth study of the philosophical thoughts on law in China from ancient Xia, Shang, and Zhou dynasties to the modern Sun Yat-sen era. Based on this research, he wrote this book, Outlines of the History of Chinese Philosophy of Law, with three objectives:
First, to deepen the understanding and recognition of various philosophical theories of law that have appeared in Chinese history. Second, to thoroughly explore the traditional legal culture of China, in order to take the essence and discard the dross, serving the construction of socialist rule of law in China. Third, the study of the history of Chinese philosophy of law in China's legal academia started relatively late, and currently it is largely in a blank state. Therefore, writing a monograph on the history of Chinese philosophy of law is an unavoidable responsibility for those of us who have long been engaged in teaching the history of legal thought. The division of labor for the authors of this book (in the order of chapter writing) is as follows: Liu Xin: Chapter 1, Chapter 2, Chapter 3 (Sections 2, 3, and 4), Chapter 4, and Sections 2, 3, 4, and 5 of Chapter 8; Wang Zhendong: Sections 6 and 7 of Chapter 3, Chapter 5; Cao Lei: Chapter 6 and Chapter 7; Xie Ying: Section 8 of Chapter 8; Du Gangjian: Chapter 9 (Sections 2, 3, 4, 5, and 6); Ran Ye: Section 5 of Chapter 3 and Section 7 of Chapter 9. Due to the late start and the limitations of individual capabilities, errors and omissions are inevitable. We welcome criticism and corrections from all sides. This book can serve as a reference for undergraduate and graduate students in law and philosophy, as well as for teaching staff engaged in the study of legal history and the history of philosophy.
