The German Civil Procedure Code has been revised through a series of laws. Mainly, the Civil Procedure Reform Act, effective January 1, 2002, fundamentally reshaped certain aspects of the Civil Procedure Code. The new revision of the German Civil Code, achieved primarily through the Debt Law Reform Act and the Rental Law Reform Act, also plays a significant role in civil procedure. The recently enacted Senior Court Representation Reform Act and the Second Law Amending Damage Provisions have also created important regulations for civil procedure. These reforms have made it necessary to revise and extensively rewrite various parts of this book. Therefore, this book reflects the current legal status. Of course, judgments and books published since the previous edition have been taken into account in the revision. We thank the readership of this book for the guidance and suggestions they have provided. Such feedback is always welcome.
