Features: The writing style of the "Case Analysis Series" consists of approximately three parts:
Part 1: Difficult Issues in the Determination and Sentencing of "A Certain Crime" (or "A Certain Type of Crime")
This part is an extension of the corresponding "Determination and Sentencing Series" that has already been published. It is the "essence" of studying a certain crime (or type of crime). Written in thematic chapters (one theme per chapter), it primarily addresses issues such as distinguishing between crime and non-crime, between this crime and that crime, between completed and attempted crimes, between one crime and multiple crimes, as well as difficult issues in sentencing. It explains authoritative views concisely.
Part 2: Case Analysis of "A Certain Crime" (or "A Certain Type of Crime")
The selected cases in this part adhere to the principle of being cases with judgments that occurred after the implementation of the new criminal law. Each case is divided into five parts:
1. Main Facts;
2. Court's Determination;
3. Difficult Issues;
4. Divergent Opinions;
5. Analysis and Comments.
In the "Main Facts" section, it briefly introduces the key content of the case; the "Court's Determination" mainly introduces the crime determined by the court and the type of penalty; the "Difficult Issues" highlights the theoretical key points of the case, guiding readers to analyze the situation; the "Divergent Opinions" provides a detailed explanation of each viewpoint and its reasoning without evaluation; the "Analysis and Comments" thoroughly analyzes the correctness and shortcomings of each viewpoint, followed by a summary that reflects the author's stance.
Part 3: Relevant Laws, Regulations, and Judicial Interpretations
This part mainly includes:
1. Relevant laws and regulations;
2. Relevant criminal judicial interpretations.
The focus is on judicial interpretations and internal regulations of relevant judicial departments.
