Features: This book focuses on maritime property rights, specifically those related to ships. Ships are tools for maritime transportation and operate in oceans and ports across different countries or regions. As objects with special functions and purposes, ships require specific regulations under maritime law to govern maritime transportation and ship-related relationships. Since maritime law is a special law of civil law in China, ship property rights should be classified as special property rights. In addition to the introduction and appendix, this book is divided into eight chapters. In the introduction, the book first elaborates on the status of ship property rights in maritime law and civil law, then briefly explains the relationship between ship property rights law and the Special Procedure Law for Maritime Litigation, private international law, public international law, and maritime administrative law. It further proposes comprehensive suggestions for improving the provisions on ship property rights in China's "Maritime Code." Finally, it briefly discusses research methods for ship property rights and the main objectives of this book.
Chapter 1 defines the concept of ships and clarifies the meaning of property rights, laying out the concept, characteristics, and types of ship property rights. Chapters 2, 3, 4, and 5 respectively elaborate on and discuss various issues related to ship ownership, ship mortgage rights, ship priority rights, and ship retention rights. Chapter 6, titled "Ship Arrest," comprehensively analyzes and explains the relationship between ship arrest and ship property rights. Chapter 7 provides a thorough explanation and discussion of the content and current status of seven international conventions related to or involving ship property rights. The English versions of these conventions are compiled in the appendix for reference. Chapter 8 focuses on the legal application issues in cross-border ship property rights relationships.
As an exploratory effort, this book treats ship property rights as a relatively independent subject for holistic research, aiming to provide theoretical foundations and specific recommendations for improving the provisions on ship property rights in China's "Maritime Code." It also serves as a comprehensive reference for related legal studies in civil law, private international law, and other fields concerning ship property rights.
