Based on the "2006 National Law Master Professional Degree Graduate Entrance Exam Syllabus" and the "National Law Master Professional Degree Graduate Entrance Exam Guide," and considering the requirements of the syllabus and the latest changes in question types, this book has been revised and published, suitable for candidates taking the National Law Master Entrance Examination and part-time Law Master candidates in 2006.
Candidates preparing for the 2006 National Law Master Professional Degree Graduate Entrance Examination are currently engaged in intensive pre-exam review. During this process, the only exam materials they can access are the aforementioned two books: the "Exam Syllabus" and the "Exam Guide." According to the eligibility requirements for enrolling in this program, candidates must be non-law undergraduates (except those participating in the October legal master professional degree graduate entrance examination for part-time legal professionals). From the perspective of past exam question types and content, these candidates are expected to possess strong legal thinking skills and solid legal knowledge training, as well as excellent legal analysis abilities. This creates a significant contrast: on one hand, these candidates have not studied any legal knowledge, have not undergone any legal thinking training, and have never used legal concepts and knowledge to analyze legal texts, cases, or events. On the other hand, from the perspective of future graduate-level study and research, these candidates must possess preliminary legal thinking and analysis skills, as well as a relatively solid foundation in legal professional knowledge. Some candidates may ask: Given the existence of the "Exam Guide," why is it necessary to publish this book? Our fundamental consideration is that, in addition to the "Exam Syllabus" and "Exam Guide," there is a need for a book to help candidates develop and strengthen their legal thinking and problem-solving abilities. From past exam questions, the primary skills required from candidates are precisely these two, yet candidates often lack them.
Second, the "Exam Syllabus" is the sole basis for the National Law Master Professional Degree Graduate Entrance Examination. Although the "Exam Guide" is written based on the "Exam Syllabus," or in essence, the "Exam Syllabus" is a condensed and simplified version of the "Exam Guide," due to the limited scope of the "Exam Guide," some issues are not fully explained, some explanations are not elaborated, and some issues are even omitted. This necessitates a supplementary study aid to fill these gaps.
Third, the "Exam Guide" is a textbook that explains basic legal knowledge in a textbook-style language, providing candidates with flat, rather than three-dimensional, legal knowledge. The various pre-exam tutoring classes candidates attend typically focus on delivering basic knowledge with supplementary examples, making it difficult for them to gain a comprehensive, three-dimensional understanding of the law. Yet, three-dimensional knowledge is a key focus of the exam. This can be verified through past exam questions: it is rare to find questions whose answers can be directly found in the "Exam Guide." Most questions cannot be directly answered using the "Exam Guide." This does not diminish the role of the "Exam Guide," which serves as a foundation for candidates. Without this foundation, candidates would have no knowledge of the law, and legal thinking and analysis skills would be impossible to develop. However, the underlying substance or the implied content within the "Exam Guide" requires a book to abstract or distill it from a different perspective.
Fourth, generally explaining the basic knowledge of exam subjects would be redundant and meaningless, as it would merely repeat the "Exam Guide." Therefore, there is a need for a book that focuses on explaining and analyzing exam key points, focal areas, and various question types, serving as a necessary supplement to the "Exam Guide" and a recommended study aid for exam preparation.
Based on the background of National Law Master Professional Degree Graduate Entrance Examination candidates and the current state of available study materials, we have organized professors and doctoral candidates from the Law School of Renmin University of China to revise and publish this book based on the new "Exam Syllabus" and referencing the revised "Exam Guide." The contributors to this book are all experts in the field. They have either participated in the development of the "Exam Syllabus" and the writing of the "Exam Guide," or have been involved in revising the "Exam Syllabus" and "Exam Guide," or have participated in the question-setting for the legal master exam, or have been employed as pre-exam tutors for National Law Master Professional Degree Graduate candidates. They have a deep understanding of the exam requirements, question-setting approaches, and answer methods and techniques for the National Law Master exam.
