Features: Law is the norm for people's lives, and it should also be a tool that people can use. The new edition of the Case-Based Legal Education Series adheres to this principle and strives to achieve the following points:
1. In terms of format design, it breaks away from the practice of simply listing cases in case books and instead organizes related cases systematically, arranging them according to the structure of each legal department, making the logic clear and the hierarchy distinct.
2. In terms of content arrangement, key terms are selected for explanation in each section, ensuring a connection between theory and cases, and reference texts of legal documents are provided for readers' better understanding and application.
3. In terms of case selection, it abandons the approach of designing cases solely for specific issues and chooses real cases with significant impact in reality, allowing readers to experience the complexity of law in real life. Small cases, vivid and interesting, reveal the vicissitudes of life; great law, equal and just, judges right and wrong. When compiling this book, the author selected real cases of civil litigation in which he participated in consultation and handling, and collected some cases with universal, typical, and representative significance from practical departments, which were then adapted. In the analysis, we base our theory on the latest judicial interpretations of civil litigation and research findings in academia, following the content and format of the current Civil Procedure Law and authoritative textbooks on civil procedure law. Through case analysis, we explain in an accessible way the key points and difficult issues of civil procedure law, balancing the practicality and theoretical nature of case reviews. It should be noted that since evidence law and execution law will be written separately, this book does not include content on evidence and enforcement.
This book is divided into several parts according to the case categories. At the beginning of each part, 2 to 5 terms are explained to help readers understand the professional terms that appear in the later case analyses. The main body consists of a certain number of cases, including case introductions, trial results, different viewpoints, and analysis, along with a certain amount of reference texts.
