"Beijing Municipal Standards for Determining the Responsibility of Parties Involved in Road Traffic Accidents" and Related Legal Regulations

Features: To ensure that the traffic management departments of public security organs determine the liability of parties involved in traffic accidents in accordance with the law and correctly, to guarantee the openness, fairness, and impartiality of traffic accident handling work, and to safeguard the legitimate rights and interests of the parties, this standard is formulated in accordance with Article 68 of the "Implementation Measures of Beijing Municipality for the Road Traffic Safety Law of the People's Republic of China," combined with the practical experience of handling road traffic accidents in this city. This standard includes: basic principles and methods for determining the liability of parties, classification of negligent acts, classification and combination of party liability, and classification of traffic accidents based on negligent acts. This standard's "Determination of Liability I" lists the circumstances where one party is deemed fully liable due to negligent acts; when determining the liability of parties, "Determination of Liability I" shall be applied first; only one party with the negligent acts listed in "Determination of Liability I" shall be deemed fully liable; if both parties have the negligent acts listed in "Determination of Liability I," both parties shall be deemed equally liable.
