Features: To address this situation and ensure the proper implementation of the "National Compensation Law." In 2001, the Supreme People's Court explicitly stated in the "Provisions on Handling Cases Involving Objections to the Court's Valid Judgments" that the Supervisory Trial Division would be responsible for national compensation confirmation cases. After accepting this task, the Supervisory Trial Division of the Supreme People's Court regarded the formulation of judicial interpretations as the top priority in carrying out national compensation confirmation work. To facilitate a better understanding and mastery of the "Provisions" among judges across the country who handle national compensation confirmation cases, we organized relevant colleagues to write this book. This book is divided into four parts:
Part I: Colleagues from the drafting group of the "Provisions" explain the content of the judicial interpretations article by article, combining with the issues encountered during the formulation process, and provide corresponding descriptions of document formats.
Part II: To further help readers understand and master the spirit of the judicial interpretations, we selected issues closely related to the judicial interpretations, such as compensation and enforcement, and invited colleagues like Ji Min, Zhang Xinmin, Wang Feihong, Zhao Jingshan, Su Ge, and Zuo Hong to write about their understanding and application of the judicial interpretations and related issues.
Part III: Considering that the work of handling national compensation confirmation cases has not been in progress for long, and it remains a completely new task for many courts, we included cases of national compensation confirmation cases that have been concluded by the Supreme People's Court. These cases reflect the specific application of the provisions of the judicial interpretations from different perspectives, providing readers with a certain intuitive understanding of the judicial interpretations.
Part IV: This part comprehensively collects laws, regulations, and judicial interpretations related to the handling of national compensation confirmation cases. During the writing of this book, we adhered to the principle of balancing theory and practice, with the hope that this book will be helpful to colleagues working in the field of national compensation confirmation case handling.
