Features: In recent years, with the further acceleration of urban construction in China, urban housing demolition has made positive progress, playing an important role in improving the living standards of urban residents, enhancing the urban landscape, perfecting urban functions, and promoting economic and social development. At the same time, urban housing demolition laws, regulations, and policies have become increasingly refined, effectively regulating demolition activities and safeguarding the legitimate rights and interests of parties involved, while ensuring the smooth progress of construction projects. On June 13, 2001, the State Council promulgated the "Regulations on Urban Housing Demolition" (State Council Decree No. 305, hereinafter referred to as "the Regulations"). The General Office of the State Council subsequently issued the "Urgent Notice on Seriously Handling Urban Housing Demolition Work and Maintaining Social Stability" and the "Notice on Controlling the Scale of Urban Housing Demolition and Strengthening Demolition Management." In 2004, the Ministry of Construction separately issued the "Guidelines on Valuation of Urban Housing Demolition" and the "Procedures for Administrative Adjudication in Urban Housing Demolition." Local governments have also formulated corresponding local regulations, rules, and policies. To enable a broad range of urban residents, especially those affected by demolition, to comprehensively, systematically, and specifically understand and master urban housing demolition laws and policies, and to legally safeguard their rights and interests while addressing difficulties and issues encountered in demolition activities, the Department of Housing and Real Estate of the Ministry of Construction organized relevant personnel to compile the book "Urban Housing Demolition Policy Explained." This book has the following features:
First, it is easy to understand. It is aimed at the general public, striving for simplicity and clarity, using plain language to address legal and professional questions.
Second, it is highly practical. It addresses issues of particular concern to the public in the form of Q&A to answer specific questions faced by parties involved in demolition activities.
Third, it covers a wide range. Starting from the basic concepts and knowledge of urban housing demolition, its content includes multiple aspects such as demolition management, compensation and resettlement, valuation, administrative adjudication, and forced demolition. It also includes laws, regulations, and rules on urban housing demolition from provinces, autonomous regions, and municipalities, as well as some laws and regulations related to demolition work, making it rich in content.
This book is suitable for the general public, especially those affected by demolition, and can also serve as an important reference for urban housing demolition workers to study and master demolition laws and policies.
