Features: Property law is the fundamental law governing property relationships and an important component of civil law. For a long time, due to the influence of the planned economy system, China's property law system has been severely lacking. In 1994, the Standing Committee of the National People's Congress included property law in its legislative plan, and in 1998, the "Civil Law Drafting Working Group" was officially established to oversee the compilation and drafting of the "Property Law of the People's Republic of China." After extensive deliberation and discussion, the "Draft for Comments" was released in January 2002, and the "Property Law (Draft)" was finalized in August 2004. The formulation of property law is a major event in China's legal system development, marking a significant breakthrough in the drafting of the Civil Code. Since the "General Principles of Civil Law" currently in effect in China lacks systematic legal provisions for basic concepts of property law, such as property rights, usufructuary rights, security interests, and possession, it has led to insufficient understanding and difficulties in comprehending the fundamental theories of property law. Therefore, this book, based on China's "Property Law (Draft)," employs illustrative examples to systematically explain the basic theories and concepts of traditional property law. It compiles a wealth of materials accumulated by the author over years of teaching and research, transforming abstract theories into concrete and vivid forms, making the content easy to understand. It is particularly suitable for undergraduate law students to self-study or as a teaching aid for instructors, as well as for legal professionals and researchers. The book is divided into two parts: the first part is the General Theory, which primarily elaborates on the principles and basic principles of property law, the basic concepts and classification of property rights, and the theory of property rights change. The second part is the Specific Theory, which, based on the content of the "Property Law (Draft)," combines the fundamental theories of traditional property law and the main views of academia, as well as the author's insights on certain issues, to specifically explain the basic types and detailed content of property rights such as ownership, usufructuary rights, security interests, and the system of possession, using real-life examples or typical cases. The book adopts an illustrative approach, incorporating the latest legislative achievements to explain the basic principles, system, and main content of property law, with a detailed analysis of the basic types of property rights such as ownership, usufructuary rights, security interests, and the system of possession. It strives to interpret profound property theories through concise and precise cases, making the content accessible to a broader audience. It also combines advanced global property concepts with China's legislative practices and specific national conditions to achieve new explorations and elevations in property theory.
