Since the Criminal Procedure Law regulates the four stages of investigation, prosecution review, trial, and execution, while also binding national investigative, prosecutorial, and judicial organs, to prevent different agencies from having varying interpretations of the same provisions in the Criminal Procedure Law, which may affect the efficiency of the state's criminal prosecution or lead to violations of citizens' basic rights, the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of State Security, the Ministry of Justice, and the Legal Affairs Commission of the National People's Congress jointly issued the Regulations on Several Issues in the Implementation of the Criminal Procedure Law on January 19, 1998, providing unified and clear interpretations on jurisdiction, case filing, recusal, evidence, transfer for prosecution, first-instance trial, and second-instance trial. The same year, the Supreme People's Court, based on the actual needs of judicial work, passed the Interpretations on Several Issues Concerning the Implementation of the Criminal Procedure Law of the People's Republic of China. This interpretation consists of 367 articles, providing in-depth and comprehensive explanations of issues that may arise during the application of the Criminal Procedure Law.
The above two regulatory documents have basically clarified the main controversial issues that may arise during the application of the Criminal Procedure Law and have provided detailed provisions for some important and abstract clauses.
