Features: Preface To adapt to the needs of China's economic construction and joining the World Trade Organization, and to strengthen research on civil and commercial legal issues by courts across the country, the National Academic Symposium Organizing Committee of the Supreme People's Court decided in January 2003 to hold the 15th National Academic Symposium of Courts with the theme "Research on Civil and Commercial Legal Theory and Judicial Practice." This symposium received a total of 1,289 submitted papers from courts at all levels across the country and from various sectors of society. According to the paper selection rules, after a rigorous, fair, open, and standardized evaluation by the selection committee, 5 papers were awarded first prizes, 92 papers were awarded second prizes, and 186 papers were awarded third prizes. These papers covered a wide range of topics, including general civil and commercial law, personal rights, debts, property rights, intellectual property rights, family and inheritance, commercial entities and commercial conduct, as well as foreign-related civil and commercial law, demonstrating considerable breadth and depth. This undoubtedly will have a positive impact on China's civil and commercial judicial practice and civil and commercial legislation. For this reason, the organizing committee has compiled and published the winning papers (first and second prizes) under the title "Research on Civil and Commercial Legal Theory and Judicial Practice" (People's Court Press, November 2003). To further promote the research outcomes of this symposium to society, systematically summarize the recent judicial experiences of courts across the country, and foster deeper exchanges and discussions among the judiciary and academia, as well as to invigorate academic research within the court system, enhance the theoretical literacy and judicial competence of judges, we have decided to compile a series of books titled "Research on Civil and Commercial Legal Theory and Judicial Practice" from among the winning third-prize papers and a select few papers that were not awarded but addressed theoretically and practically valuable issues with strong arguments. The complete series consists of 8 volumes, including "Theories and Applications of Debt Law I (General Principles and Contractual Debts)," "Theories and Applications of Debt Law II (Tort Debts)," "Theories and Applications of Property Law," "Theories and Applications of Intellectual Property Law," "Theories and Applications of Marriage Law," "Theories and Applications of Commercial Entity Law," "Theories and Applications of Commercial Conduct Law," and "General Civil and Commercial Law and Theories and Applications of Foreign-Related Civil and Commercial Law."
The annual National Academic Symposium of Courts has been held for fifteen editions so far, and the paper collection work for the 16th edition is also underway in an orderly manner. Over the past 16 years, the National Academic Symposium of Courts has become the official platform for judges across the country to engage in theoretical research and academic exchanges. It is renowned for its high standards, strict organization, fairness, impartiality, and transparency, earning it the title of the "Olympic Games" of the court system. Therefore, we hope that courts at all levels will attach great importance to this form of academic exchange, continue to support and participate in this grand academic event as always, and strive to improve the professional quality and theoretical cultivation of judges, thereby upholding the century-old theme of "Justice and Efficiency." We also hope that judges across the country will fully utilize this platform to broadly exchange and summarize their judicial experiences, contributing their strength to the nation's legal construction and judicial practice.
