Features: Civil Procedure Law is distinct from other legal disciplines due to its strong practicality and flexibility, making it more challenging to master. The teaching of civil procedure law requires cultivating students' independent thinking abilities, forming their own logic, and drawing convincing conclusions. Relying solely on theoretical education is difficult to fully equip students with mastery of this subject. However, case-based teaching methods can stimulate students' enthusiasm, encouraging them to actively engage with the issues embedded in cases and combine theoretical knowledge to derive their own conclusions. The purpose of this book is to help students better master this discipline by selecting and analyzing typical cases in civil procedure law. The book includes 62 cases, which exhibit the following characteristics:
(1) Systematicity. The cases cover major issues in civil procedure law, systematically analyzing and discussing each key problem from the perspective of the discipline.
(2) Novelty. The cases are primarily judgments from recent years, aiming to reflect the current state of judicial practice and the prevailing trends in court rulings.
(3) Typicality. Efforts have been made to select cases that represent typical examples of their respective types, using them to illustrate relevant issues.
(4) Realism and Practicality. The main content and key details of the cases are derived from relevant judicial precedents from courts at various levels in China, aiming to enhance their persuasiveness and authority through real-world examples.
(5) Inspiration. Cases serve as the starting point of reflection, not the end. Therefore, we have consciously chosen cases that offer more room for thought.
(6) Readability. Since court judgments are often complex and lengthy, we have edited and revised the selected cases to improve their readability and ease of comprehension for students.
In the analysis of each case, to help students better understand and master the relevant knowledge, we divide the analysis into two aspects:
- Analyzing the theoretical background of the case, including relevant regulations from other countries, theoretical disputes, and various doctrines.
- Evaluating the case based on China's specific provisions and the specifics of the case, providing commentary on certain aspects of the court's judgment.
