Features: Civil adjudication is an important part of the people's court's adjudication work, closely related to social stability, economic development, and the lives of the people. Currently, China's civil adjudication work faces rare development opportunities. The development of the market economy and the improvement of legal awareness have created abundant and continuous subjects and materials for civil adjudication; the steady progress of legal system construction and the gradual deepening of adjudication reform and judicial reform have provided a favorable external and internal environment for civil adjudication; the proposal of the judicial theme of fairness and efficiency has clarified the basic work objectives and direction for civil adjudication; and society is increasingly paying attention to civil adjudication, with its stage becoming broader.
The other side of the opportunity is the challenge: the Party and the State place high hopes on civil adjudication; the people have put forward increasingly higher requirements for civil adjudication; the deepening of reforms requires civil adjudication to fully fulfill its function of ensuring social stability; the continuous increase in the number of civil cases and the growing complexity of civil legal relations have increased the workload of civil adjudication; and China's entry into the WTO also requires civil adjudication judges to further transform their concepts and standardize law enforcement.
Facing such circumstances, we must strengthen research and guidance in civil adjudication, focusing on solving various difficult and complex issues and those concerning the people. This is the basic requirement for doing well in adjudication, reform, and team building, as well as the objective need to adhere to people-centered principles and continuously improve the professional level of adjudicators, cultivating a large number of civil judges with strong legal theory foundations and rich adjudication experience.
Cases are living legal textbooks. Although China is not a common law country, good cases have a practical role, making it easier for us to refer to them to accurately resolve similar cases, and they have always played a positive role in practice. Strengthening case research and promoting outstanding cases has a positive significance for continuously improving the professional level of adjudicators and promoting judicial uniformity.
Beijing is the political, cultural, and economic center of the country. Beijing's civil adjudication has both the general characteristics of civil adjudication nationwide and the unique features of the capital, such as high case growth rates, many new types of cases, large sums in litigation, and strong legal awareness among parties. In recent years, the civil adjudication of Beijing courts has made positive and steady progress in reforming the adjudication methods and various reforms under the guidance of leaders at all levels and the joint efforts of all adjudicators, focusing on the function of civil adjudication and creating and summarizing many good experiences and practices. At the same time, by adopting various methods to strengthen research and guidance, they have effectively ensured judicial uniformity, thereby improving the quality of case adjudication and making positive contributions to safeguarding the social stability and economic development of the capital.
Beijing courts fully value the role of case research in their research and guidance work. While fulfilling the arduous tasks of adjudicating civil cases, they do not stop at adjudication itself but focus on summarizing adjudication work through cases to guide and regulate practice, creating a legal research atmosphere, and introducing many outstanding cases. This book is a result of the Beijing Intermediate People's Court's efforts to strengthen its civil adjudication case work, featuring broad and representative cases, strong novelty, well-organized and concise formats, and relatively in-depth legal analysis, embodying their wisdom and hard work. It is an important display of the civil adjudication work of Beijing courts.
The publication of this book is believed to provide references and learning materials for civil adjudication work at all levels of courts, offer fresh issues and materials for legal research, and play a positive role in social understanding, attention to civil adjudication, and the people's study of civil law.
Civil adjudication is profound and extensive, developing with society, with new and complex issues constantly emerging, requiring summary and research by courts and judges at all levels nationwide. It is hoped that Beijing courts will leverage their role as capital courts to achieve greater achievements in adjudication work and research.
The content of this book has the following characteristics:
1. Comprehensiveness. The cases collected in this book cover various aspects such as real estate, personal injury, compensation for damages, consumer rights, medical disputes, deposits and insurance, labor disputes, marriage and family, and inheritance, encompassing all types of civil cases; both substantive law cases and procedural law and evidence law cases are included.
2. Novelty. Most of the cases are real cases adjudicated by Beijing courts in the past one or two years; the legal relationships reflected in the cases are novel, with some even being gaps in legislation and academia; in terms of legal application, they apply to newly promulgated laws and judicial interpretations, with some cases even applying to the new Marriage Law.
3. Typicality. The selected cases represent typical issues frequently encountered in court adjudication practice.
4. Concise Analysis. Most of the book consists of analyses by judges of the cases they handled, featuring the "judge's perspective" approach.
