It examines the independent status and functions of industry associations in the market economy and civil society, thereby deriving the necessity of industry association autonomy. The author thens an exposition and interpretation of the constitutional basis of industry association autonomy, comparing the similarities and differences of industry associations across various countries. The book focuses on an in-depth explanation of the specific contents of industry association autonomy rights, such as the authority to formulate rules, non-legal punitive powers, dispute resolution powers, regulatory powers, and the right to sue. Subsequently, the author analyzes and explains the conditions for the realization of industry association autonomy and the current state of industry association autonomy in China. At the end of the book, the author discusses the limits of industry association autonomy from the perspective of antitrust law.
The rise of social intermediary organizations has been a bright spot in the development of civil society in the 20th century, and in China, it is also burgeoning. Among these intermediary organizations, industry associations, as the most important component, have garnered increasing attention and importance. They are not only the foundational force of civil society but also an effective alternative to state failure. As a result, numerous disciplines and scholars have devoted considerable passion and effort to industry associations. However, we once again find ourselves disappointed by the lagging and underdeveloped state of legal research in this field, while law should have been one of the main forces in theoretical research on industry associations.
To address the shortcomings of legal research and to enhance and refine the theoretical research level of industry associations in China, this book conducts research on various issues related to industry associations from the perspective of economic law. Running through all the issues is the economic autonomy of industry associations. In the author's view, autonomy is the most essential characteristic and the most fundamental structural condition of industry associations, as well as a theoretically crucial issue that should be clarified. However, scholars have conducted relatively scarce and unsatisfactory research on this topic.
This book stands firmly on the position of fully affirming and supporting the economic autonomy of industry associations, employing multidisciplinary knowledge to explore the many interconnected issues related to industry association economic autonomy. It also reveals, explains, and looks ahead to the current state of industry association autonomy in China. The entire book contains over 200,000 words and is divided into three parts, consisting of seven chapters.
