Publish Date: 2000-06-01
Features: The issue of rights is a fundamental problem in contemporary humanities and social sciences, and more importantly, a hot topic in legal philosophy as a branch of philosophy and law. This book is the first to conduct a comprehensive study of the phenomenon of rights from the perspective of legal philosophy. The author divides the history of research on legal philosophy of rights into three periods: the embryonic period, the classical period, and the developmental period, and focuses on analyzing the basic views of Marxist legal philosophy of rights. On this basis, the author constructs a macro-theoretical framework for the study of contemporary Chinese legal philosophy of rights, namely the ontology of rights, the axiology of rights, and the operational theory of rights, and provides systematic arguments for these three parts. The content of this book has both theoretical and practical significance for improving China's rights theory and promoting the development of China's legal system.
