Features: Collective bargaining is the primary means of adjusting labor relations under market economy conditions and an international practice. By regulating labor relations through collective bargaining, it forms the core of labor relations systems in market economy countries. Collective bargaining not only establishes formal rules for adjusting labor relations but is also a crucial mechanism for resolving conflicts. It effectively encourages both labor and capital to compromise, reach agreements, and reduce negative impacts such as strikes, slowdowns, and resignations. Solving labor conflicts during periods of upheaval through collective bargaining is both cost-effective and efficient. This book studies and analyzes the theories, doctrines, value judgments, and the structure, levels, characteristics, and models of collective bargaining systems in modern Western market economy countries. It also outlines the legislation and experiences of collective bargaining systems in Western countries. Building on the experiences and systems of collective bargaining in market economy countries, and based on the practical needs of labor relations development in China, it analyzes the main issues encountered in China's collective bargaining system in terms of legislation and practice. Theoretical explorations are conducted on topics such as the role definition of bargaining subjects, the identification and remedy of improper labor behaviors, the responsibility of good-faith bargaining, and the systems for collective agreements and collective dispute resolution. Labor relations issues are becoming a major and sensitive social problem that cannot be avoided in China's economic development process. Collective bargaining is premised on the right to association of workers and guaranteed by the right to dispute resolution, reflecting the concept of autonomy between labor and capital. The effective operation of this mechanism relies on the independence and development of trade unions and employer organizations, as well as the reform of the current model of trade union work. Bargaining subjects must be independent and representative, and democracy must be reflected within trade union organizations. From the experience of countries around the world, establishing and improving a democratic political system is a necessary condition for the substantial development of collective bargaining systems.
