China Letter of Credit Law and Important Case Comments (2002)

Features: According to my original plan, I have now compiled and published articles completed since 2002, both published and unpublished, as well as collected court judgments, to serve as a continuation of the previous volume. Together, the cases in the two books nearly reach 100. I hope these materials can provide some reference for peers in the banking, judicial, and trade sectors when practicing. I wonder if there will still be an opportunity to continue this work in the future. From the current trend, more and more courts are publishing their judgments in various ways, which is a great thing. This is not only very helpful for academic research in this field but also allows the banking and trade practice sectors to understand the legal consequences of their commercial activities, greatly benefiting the predictability and certainty of legal consequences in commercial transactions. For the judicial judgments themselves, it can also enable judges to share their judicial wisdom with each other, which is also very beneficial for gradually improving the judicial standards of courts at all levels in this field. The laws and cases covered in this book are up to May 2003 and are limited to the scope of cases I have collected. Some cases, although known to have judgments, could not be obtained due to the lack of appropriate channels. The date for the ICC materials is also the same. Due to time constraints, the cases of letters of credit from various countries, especially English-speaking countries, published in the 2002 Letter of Credit Annual Report by the American International Bank Law and Practice Association this year were not included. Since this book is about China's letter of credit law and cases, the absence of this material will not have a significant impact.
