Features: The "Civil Procedure Law" is a fundamental law of the state and a procedural law relative to civil and commercial substantive law. Civil procedure law is a theoretical science with a unique theoretical framework and system, but it also has strong applicability and practicality. With the establishment of the socialist market economy system and the reform of the judicial system, the Supreme People's Court has issued a series of judicial interpretations, replies, and guiding opinions targeting civil procedure practice. Research in civil procedure law theory has also made significant progress. Driven by the operational requirements of civil procedure practice and the need to adapt to the demands of legal education and judicial examinations in the new century, we have compiled this textbook. This textbook has the following four advantages:
(1) Emphasis on the theoretical nature of civil procedure law. To align with the characteristics of civil procedure law as a theoretical science, this textbook not only clarifies the basic system of civil procedure law but also elaborates on and analyzes its related theories, fostering students' legal thinking abilities and enhancing their academic competence. At the end of each chapter, thinking questions are provided, highlighting key theoretical debates, and a list of relevant books and academic papers is included to guide students in deeper reflection.
(2) Focus on the practical nature of civil procedure. To suit the practical characteristics of civil procedure, this textbook analyzes critical stages of the procedural process with the help of judicial practice cases, cultivating students' litigation awareness and enabling them to adapt more quickly to judicial practice after graduation.
(3) Reasonable arrangement of the textbook format. To facilitate students' learning of this course, after introducing the basic knowledge of civil procedure law, this textbook arranges key issues into sections such as definitions of terms, multiple-choice questions, thinking questions, and case analyses, allowing students to comprehensively study and reflect on the content.
(4) Innovation in writing style. To showcase the features of civil procedure law, this textbook innovates in style. At the beginning of each chapter, a chart is used to clearly outline the main content, making it easy for students to grasp the key points at a glance. Relevant laws and regulations are listed in the text, enabling students to understand the content of the textbook in conjunction with legal provisions.
